Terms and Conditions of Service and Subscription

1. Identification of the service provider

Hereinafter, FA comunicación, TimeDivers or the service provider.
These terms govern the creation of accounts, the use of TimeDivers and the purchase of its paid plans.
2. Acceptance and formation of the contract
By creating an account, using TimeDivers or purchasing a plan, the user declares that they have read and accepted these terms.
Before purchasing a paid plan, the user may review the main characteristics of the service, the price, applicable taxes, billing frequency, renewal, payment methods, and the cancellation and withdrawal conditions.
During the checkout process, the user may review and correct the information entered before confirming the order. The contract is concluded when the order is accepted and the corresponding confirmation is sent to the email address provided.
The order confirmation, the information displayed during checkout and these terms form part of the contract. The user should retain a copy of the confirmation and may save or print these terms.
Contracts may be concluded in Spanish or English. In the event of any discrepancy between the two versions, the Spanish version shall prevail, without prejudice to any mandatory rights granted to the user under applicable law.
3. Age and legal capacity requirements
TimeDivers is not intended for children under the age of 16, who may not directly create an individual account.
Users aged 16 or 17 may use a free account with the authorisation of their parents or legal guardians.
Premium and Pro plans must be purchased by a person aged 18 or over or by the minor's legal representative.
Any person using TimeDivers on behalf of a company, institution or organisation declares that they have sufficient authority to accept these terms on its behalf.
4. Account creation and security
An account is required to use the timeline creation and management features.
The user must provide accurate information and keep their email address up to date. This address will be used for communications concerning the account, payments, renewals, security, and the possible deletion of content or inactive accounts.
Login credentials are personal and must not be shared with unauthorised persons. The user is responsible for activity carried out through their account where their credentials have been correctly used, unless they have reported unauthorised access or the activity is attributable to circumstances beyond their control.
The user must notify TimeDivers as soon as possible if they suspect that their account has been used without authorisation.
Accounts may not be sold, assigned or transferred to another person without TimeDivers' authorisation, and additional accounts or technical mechanisms may not be used to circumvent plan limits.
TimeDivers may request reasonable information to verify ownership of an account when its recovery, modification or deletion is requested.
5. Description of the service
TimeDivers enables users to create, edit, store, view, share, embed, import, export and customise digital timelines.
Timelines may contain events and periods, dates, text, tags, cover images, images, documents, attachments, linked videos, attributions, licences and other resources supported by the platform.
The service provides a vertical view and a horizontal view, search and filtering tools, sharing links, iframe embedding, and different import and export formats depending on the plan.
TimeDivers is a content creation and presentation tool. TimeDivers does not verify the accuracy of information added by users.
6. Plans
TimeDivers offers Free, Premium and Pro plans.
The current features, limits, prices and billing frequencies are shown on the pricing page and, for paid plans, during the checkout process. The information displayed when the order is confirmed forms part of the contract.
When an account is created, it is initially assigned the Free plan. Purchasing Premium or Pro increases the available features and limits for the paid period.
7. Changes to plans and features
TimeDivers may introduce new features, improve existing ones or discontinue features that have become obsolete or insecure, depend on services that are no longer available, or are no longer technically or legally viable.
Changes that materially reduce the benefits of a paid plan will be communicated with reasonable advance notice and will not apply retroactively to a period already paid for, unless they are necessary to comply with a legal obligation, protect security or prevent serious harm.
If a material change is to apply upon the next renewal, the user will be informed at least 30 days in advance so that they may cancel the renewal if they do not wish to continue.
Minor changes, corrections, security improvements or adjustments that do not materially reduce the service may be implemented without prior notice.
8. Timeline visibility
The user selects the visibility setting from the options available under their plan.
8.1. Public
Public timelines may be viewed by anyone, appear in public sections of TimeDivers and in search engines, be shared by link, and be embedded on other websites.
The user must assume that public content may be copied, downloaded, archived, captured or distributed by third parties.
8.2. Unlisted
Unlisted timelines are not intended to appear in general public listings, but anyone who has the link may access them.
The link may be forwarded. Unlisted visibility should therefore not be used as a confidentiality mechanism.
8.3. Private
Private timelines are accessible only to the account owner, without prejudice to the limited technical access that may be necessary to provide support, maintain security, investigate an incident or comply with a legal obligation.
Private timelines cannot be embedded on external websites.
9. User content
The user retains any rights they hold in the original content they add to TimeDivers.
By uploading, creating, importing or publishing content, the user grants TimeDivers a non-exclusive, royalty-free licence limited to what is necessary to:
- Host, store and back it up.
- Reproduce it and adapt it technically for proper presentation.
- Generate thumbnails, previews, embeds and exports.
- Display and distribute it in accordance with the selected visibility setting.
- Include public timelines on public TimeDivers pages or listings.
- Maintain, protect and provide the service.
This licence does not transfer ownership of the content to TimeDivers. It ends when the content is deleted from active systems, without prejudice to its temporary retention in backups or any retention required by law.
TimeDivers will not use private or unlisted content for advertising unrelated to the provision of the service without the user's authorisation.
10. Responsibility for content
The user is responsible for ensuring that the content they add:
- Is lawful.
- Does not infringe copyright, trade marks, image rights, privacy, data protection or other rights.
- Does not contain malware or compromise security.
- Is covered by the necessary permissions, licences or legal grounds.
The fact that an image, document, video or text is available on the Internet does not mean that it may be used freely.
When the user imports images or files from an external address, they declare that they hold the necessary rights and authorise TimeDivers to download and add them to their account.
TimeDivers may request information about the source or authorisation of content where a substantiated complaint has been received.
11. Prohibited uses
TimeDivers may not be used to:
- Commit, promote or facilitate unlawful activities.
- Publish content that infringes the rights of third parties.
- Disclose personal data unlawfully.
- Impersonate another person or entity.
- Threaten or harass others, or unlawfully incite violence or hatred.
- Host, publish, share or facilitate any criminal content or any content that promotes, incites or facilitates the commission of criminal offences.
- Distribute malware, viruses, fraudulent links or harmful files.
- Send unsolicited communications or engage in spam.
- Access accounts, systems or data without authorisation.
- Interfere with the operation or security of the service.
- Circumvent limits, restrictions, access controls or protective measures.
- Extract content by automated means or scrape the service without authorisation.
- Decompile, reverse engineer or attempt to obtain the source code, except where expressly permitted by law.
- Use the platform in a way that places a disproportionate load on its infrastructure.
These rules are further developed in the Acceptable Use and Illegal Content Reporting Policy.
12. Moderation, content removal and suspension
TimeDivers does not carry out general prior monitoring of all content added by users.
It may review content when it receives a sufficiently precise notice or an order from an authority, detects a possible infringement, or needs to investigate a technical or security issue.
Depending on the nature and seriousness of the situation, TimeDivers may:
- Restrict the visibility of content.
- Disable its embedding or sharing.
- Remove a file or timeline.
- Restrict certain features.
- Temporarily suspend an account.
- Terminate the contract and close the account.
Measures will be taken diligently, objectively and proportionately. Where appropriate, the affected user will be informed of the decision, the reasons for it and the available means of requesting a review, unless this is prevented by law, an authority or legitimate security considerations.
Security tools may apply automated blocks in response to attacks, access attempts or suspicious technical behaviour. Decisions concerning the lawfulness of content will be assessed on the basis of the available information and, where appropriate, through human review.
In serious, urgent or legally required situations, TimeDivers may act without prior notice.
13. Third-party services and content
Timelines may contain links or videos hosted by external services such as YouTube or Vimeo.
TimeDivers does not control the availability, continuity, content, terms or policies of those services. An external resource may become unavailable, change, impose geographical restrictions or display advertising.
The user is responsible for complying with the external provider's terms when adding or using its content.
TimeDivers also relies on hosting, payment, email, security and other infrastructure providers. An incident affecting these providers may temporarily affect the service.
14. Embedding, sharing, imports and exports
Public and unlisted timelines may be embedded on other websites using the code provided by TimeDivers. Private timelines cannot be embedded.
The user must not alter the embed code to circumvent controls, conceal required attributions or present the content in a misleading manner.
Embeds and exports under the Free plan may include TimeDivers branding. Premium and Pro reduce that branding, although TimeDivers may retain a minimal and discreet attribution.
Imports are subject to the available formats, limits, validation rules and storage capacity. TimeDivers may reject incompatible, damaged or unsafe files, or files that exceed applicable limits.
Exports reflect the data that each format can technically include. Videos and other resources hosted by third parties may be exported as links or references rather than as files.
Once the user has shared, embedded, downloaded or exported content, TimeDivers cannot control copies retained outside TimeDivers.
The user should keep independent copies of any content they consider particularly important.
15. Prices, taxes and billing
The applicable prices, currency, taxes and billing frequency are shown before the purchase is confirmed.
Where applicable, value added tax or other taxes will be calculated in accordance with the billing information and applicable law.
The user must provide complete and accurate billing information and keep it up to date.
Payments are processed through WooPayments and its associated payment providers. TimeDivers does not store the full card number or security code.
The user authorises the charge of the amount shown during checkout and, for subscriptions, the recurring charges required for renewals until cancellation.
16. Term and automatic renewal
Premium and Pro plans may be purchased on a monthly or annual basis, depending on the options available during checkout.
The subscription begins when payment is confirmed and remains active for the purchased period.
Unless the user cancels it, the subscription will renew automatically for equal periods using the saved payment method and at the price applicable to the renewal.
TimeDivers will send the consumer a reminder at least 15 days before the deadline for stating that they do not wish to renew, explaining the consequences of not cancelling.
The user is responsible for keeping their email address, payment method and billing information up to date.
17. Price changes
TimeDivers may change plan prices.
A new price will not apply to a period already paid for. It may apply to a future renewal.
The user will be informed of the new price and its effective date at least 30 days in advance. They may cancel the renewal before the next charge if they do not wish to continue.
A temporary promotion or discount does not require the same price to be maintained for subsequent renewals unless expressly stated otherwise during checkout.
18. Cancellation of renewal
The user may cancel automatic renewal from their account.
Cancellation:
- Prevents charges for subsequent periods.
- Does not immediately delete the account or its timelines.
- Does not interrupt access to the plan already paid for.
- Takes effect at the end of the current billing period.
- Does not by itself entitle the user to a refund for the unused portion of the current period.
A cancellation made after a new charge has been processed will apply to the following renewal, without prejudice to the right of withdrawal and any other statutory consumer rights.
19. Plan changes
The user may change plans when the corresponding options are enabled.
Before the change is confirmed, its effective date, any applicable amount and the consequences for the account will be displayed where appropriate.
Changing to a plan with lower limits may leave the account above the permitted capacity. In that case, the restricted account rules set out in the following section will apply.
20. Restricted accounts after a downgrade
When a subscription ends or the user moves to a lower plan and their account exceeds the limits of the new plan, the account becomes restricted.
While the account is restricted:
- No new timelines may be created.
- Content may not be edited or imported.
- Public timelines may remain visible.
- The user may delete timelines.
- The user may purchase a sufficient plan again.
- The user may use the enabled ZIP export to retain a copy of their data.
The user has three months from the effective date of the downgrade to purchase an appropriate plan again, reduce their content to comply with the limits, or export it.
TimeDivers will send a notice when this period begins and another notice at least seven days before it ends.
If the account has not been brought into compliance by the end of the three-month period, TimeDivers may delete all timelines and files associated with the account, not only the content that exceeds the limits.
This deletion will be irreversible and will cause the corresponding public links and embeds to stop working.
Bringing the account into compliance before the deadline cancels the scheduled deletion.
21. Failed payments
If a renewal payment fails, TimeDivers or its payment provider may:
- Make further payment attempts.
- Send notices to the user.
- Allow the payment method to be updated.
- Allow the outstanding order to be paid manually.
- Temporarily suspend paid-plan features while the issue is being resolved.
If the payment is not brought up to date, the subscription may end and the account will move to the Free plan. If it then exceeds the applicable limits, the restricted account rules and three-month period set out in these terms will apply.
The fact that further payment attempts are made does not require TimeDivers to keep the plan active indefinitely while payment remains outstanding.
22. Difference between cancelling, deleting content and deleting the account
Cancelling a subscription prevents future renewals, but keeps the plan active until the paid period ends and does not delete content.
A downgrade moves the account to a lower plan and may cause a restriction if the content exceeds the new limits.
Deleting a timeline removes only that timeline and its associated files.
Deleting the account ends access to the service and removes the profile and associated content, except for information that must be retained by law. The user may request deletion of their account through the options available in the service or by writing to TimeDivers.
If the account has an active subscription, deleting it will also cancel future renewals. The user retains any rights granted to them by law in relation to the period already paid for.
Account deletion is separate from ordinary cancellation and does not by itself create a right to a refund for any unused part of the period, without prejudice to the consumer's statutory rights.
Before deleting the account, the user must download any content they wish to retain.
23. Inactive Free accounts
TimeDivers may delete a Free account where no login has occurred for a continuous period of two years and there is no active paid subscription.
A first notice will be sent at least 60 days in advance and a second notice at least seven days before deletion.
Logging in before the stated date cancels the scheduled deletion.
If the user does not log in within the period provided, TimeDivers may delete the account and all its content, including public timelines, links and embeds.
The user is responsible for keeping the account email address up to date in order to receive these notices.
24. Right of withdrawal
This section applies only to persons purchasing a plan as consumers for purposes outside their trade, business or profession.
The consumer may withdraw from the purchase of a paid plan within fourteen calendar days of the conclusion of the contract, without giving any reason.
To exercise this right, the consumer may send an unequivocal statement to info@timedivers.net or use the model form provided at the end of these terms.
If the withdrawal is communicated within that period, FA comunicación will refund in full all amounts paid for the purchased plan, even if the service was activated and used during that period.
The refund will be made without undue delay and, in any event, within fourteen calendar days of the date on which FA comunicación was informed of the withdrawal. The same payment method used for the purchase will be used, unless the consumer expressly agrees otherwise.
Withdrawal will end the paid plan. The account will move to the Free plan unless the user also requests its deletion. If the content exceeds the Free plan limits, the restricted account rules set out in these terms will apply.
25. Refunds
Outside cases in which a refund is required by law, TimeDivers does not offer a general commercial refund policy for:
- Ordinary cancellation of a subscription.
- Failure to use the service.
- Voluntary deletion of an account.
- Purchasing a plan with more capacity than was ultimately used.
- Failure to cancel before a renewal that was properly notified.
Duplicate charges, amounts charged in error and any other cases in which a refund is legally required will be corrected.
The user must report any billing issue to info@timedivers.net and provide the information needed to identify the transaction.
This clause does not limit any rights the consumer may have due to lack of conformity of the service or for any other reason provided by law.
26. Support
Premium users receive basic support by email. Pro users receive priority support.
Priority support means that Pro enquiries are given priority within the work queue, but it does not imply continuous availability or guarantee any specific response or resolution time.
Support is limited to the operation of TimeDivers. It does not include content creation or review, obtaining licences, legal advice, historical research, or guaranteed recovery of deleted information.
27. Availability, maintenance and backups
TimeDivers takes reasonable measures to keep TimeDivers available, secure and operational.
The service may be temporarily interrupted due to maintenance, updates, incidents, provider problems, attacks, connection failures, force majeure or circumstances beyond TimeDivers' reasonable control.
Where possible, scheduled maintenance that materially affects the service will be announced in advance.
TimeDivers backups are intended for general recovery from failures or incidents. They do not constitute an individual archiving service and do not guarantee recovery of a particular timeline or file deleted by the user.
The user should keep their own copies of important content using the available export tools.
28. Conformity of the service
The TimeDivers service will be provided in accordance with the features offered, these terms and the rights granted to consumers and users by law.
If the service is not in conformity, the consumer may exercise the remedies provided by applicable law, including, where appropriate, bringing the service into conformity, a price reduction or termination of the contract.
Nothing in these terms excludes or limits any mandatory consumer guarantees or rights.
29. Liability
TimeDivers will be liable for damage attributable to it in accordance with applicable law.
TimeDivers is not liable for:
- The legality, accuracy or reliability of content created by users.
- Loss or disclosure of content caused by the user's visibility or sharing choices.
- Copies made by third parties outside TimeDivers.
- The unavailability of or changes to external services.
- Damage arising from the user's breach of these terms.
- Access to an account caused by the user sharing or inadequately protecting their credentials.
- Interruptions caused by force majeure or circumstances beyond its reasonable control.
These exclusions do not apply where the damage is attributable to wilful misconduct or gross negligence by TimeDivers, or where liability cannot legally be limited.
In dealings with businesses or professionals, and to the extent permitted by law, TimeDivers' total liability for direct damage relating to the service will be limited to the amount actually paid by the user during the 12 months preceding the event giving rise to the claim. Liability that cannot legally be excluded will not be limited.
The user will be liable for damage and claims caused by unlawful use of the service or an infringement of third-party rights attributable to the user.
30. Data protection and cookies
The processing of personal data is governed by the Privacy Policy.
The use of cookies and similar technologies is governed by the Cookie Policy.
A user who adds personal data relating to other people to their timelines must have a valid legal basis and comply with the obligations applicable to them.
31. Changes to these terms
TimeDivers may update these terms to reflect legal, technical, organisational or functional changes.
Material changes will be communicated to users by email or through a prominent notice in the service.
Unless they must take effect earlier due to a legal obligation or an urgent security need, changes that materially affect a paid subscription will be communicated at least 30 days in advance and will not retroactively alter a period already paid for.
If the user does not accept a change, they may cancel their renewal and stop using the service before the effective date.
32. Termination by TimeDivers
TimeDivers may suspend or close an account where:
- There is a serious or repeated breach of these terms.
- The service is used for unlawful activities.
- Third-party rights are infringed.
- The security or stability of the platform is compromised.
- There is fraud or non-payment.
- A competent authority so orders.
- The account was created in breach of the age or legal capacity requirements.
- The inactivity rules applicable to Free accounts are triggered.
Whenever possible and proportionate, the user will be informed of the reasons and allowed to request a review.
Prior notice will not be required where there is an immediate risk, a particularly serious infringement, a legal obligation, or an urgent need to protect other persons or the service.
Where legally possible and not prevented by the reason for termination, a period may be granted for exporting lawful content before its deletion.
33. Governing law and dispute resolution
These terms are governed by Spanish law, without prejudice to any mandatory rules of the consumer's country of residence that may apply.
Complaints may be sent to info@timedivers.net. TimeDivers will respond as soon as possible and, in any event, within the maximum period required by law.
Where the user acts as a consumer, any dispute will be submitted to the courts having jurisdiction under applicable law.
Where the user acts as a business or professional, and where permitted by law, the parties submit to the courts of Madrid, Spain.
If any provision is invalid or unenforceable, the remainder of these terms will remain valid.
