Acceptable Use and Illegal Content Reporting Policy

1. Purpose and scope

This policy governs:

  • Content and uses that are permitted and prohibited on TimeDivers.
  • Reports of content that a person considers illegal.
  • The review of those reports.
  • The measures TimeDivers may take in relation to content, timelines and accounts.
  • The procedure for requesting a review of a decision.

This policy supplements the Terms and Conditions of Service and applies to all accounts and content hosted, published, shared, embedded or imported through TimeDivers.

It covers, among other elements, text, images, documents, attachments, linked videos, tags, titles, descriptions, links, personal data and other materials added to timelines.

Hereinafter, TimeDivers.

2. User responsibility

The user is responsible for the content they create, add, import, share or publish through their account.

Before using any content, the user must check that:

  • Its use is lawful.
  • They hold the necessary rights, permissions, licences or legal grounds.
  • It does not infringe the rights of third parties.
  • It does not contain malware or compromise the security of the service.
  • Its publication or distribution complies with applicable law.

The fact that an image, document, video, text or other material is available on the Internet does not mean that it may be used freely.

A user who adds personal data relating to other people must have a valid legal basis and respect the rights of the persons concerned.

3. No general monitoring

TimeDivers does not review or approve in advance all content added by users.

The presence of content on the platform does not mean that TimeDivers:

  • Has verified it.
  • Shares the opinions expressed.
  • Guarantees its accuracy.
  • Confirms that its use is lawful.
  • Has authorised its publication.

TimeDivers may review specific content when it receives a report, complaint or order from an authority, detects a possible infringement, or needs to investigate a technical or security incident.

The review may also extend to private or unlisted content where this is essential to address a report, protect the service, provide support, comply with a legal obligation or investigate a possible infringement.

4. Illegal content and activities

TimeDivers may not be used to create, host, publish, share, embed, import, link to, distribute, promote or facilitate illegal content or activities.

This prohibition covers any content whose creation, possession, storage, publication, distribution, sale or use is contrary to applicable law.

In particular, TimeDivers may not be used to:

  • Commit, promote, incite or facilitate criminal offences, or to host or distribute criminal content.
  • Infringe third-party rights, including intellectual property rights, image rights, honour, privacy, data protection or any other legally protected right.
  • Carry out fraud, impersonation, unauthorised access, distribution of malware or other activities that compromise the security of persons, accounts, systems or data.

These categories are illustrative only. TimeDivers may act against any illegal content or activity, even if it is not expressly mentioned.

5. Content not permitted by TimeDivers

In addition to illegal content, TimeDivers does not permit:

  • Pornography or content primarily intended for sexual arousal.
  • Advertisements, offers or promotion of sexual services.
  • Graphic violence presented gratuitously, morbidly or sensationally.
  • Harassment, intimidation or stalking directed at a person.
  • Threats, serious humiliation or malicious exposure of personal data.
  • Spam or unsolicited mass communications.
  • Impersonation or misleading presentation that may cause others to believe that an account or content belongs to someone else.
  • Content or activities intended to manipulate, overload, breach or interfere with the operation of TimeDivers.
  • Mechanisms intended to circumvent plan limits, access controls, security restrictions or moderation measures.
  • Automated extraction of content or scraping without authorisation.
  • Use of the service as general file hosting unrelated to a legitimate timeline.

These prohibitions may apply even where the specific content does not constitute a criminal offence.

6. Historical, educational, artistic and documentary contexts

TimeDivers may permit images, text or accounts that include nudity, violence, wars, persecution, crime, illness, medical procedures or other sensitive matters where there is a legitimate purpose:

  • Historical.
  • Educational.
  • Academic.
  • Scientific.
  • Medical.
  • Journalistic.
  • Artistic.
  • Documentary.

The context, manner of presentation, level of detail, purpose and measures taken to protect the persons concerned will be considered when assessing the content.

A historical, educational or documentary purpose does not permit the publication of illegal content or remove the obligation to respect third-party rights.

7. False, controversial or offensive content

TimeDivers does not generally verify the truthfulness of user content.

Content will not be removed solely because it is:

  • False or inaccurate.
  • Controversial.
  • Biased or one-sided.
  • Satirical.
  • Fictional.
  • Offensive.
  • Contrary to a political, religious, historical, scientific or social opinion.

However, action may be taken where the falsehood forms part of fraud, impersonation, a threat, an infringement of honour, a breach of rights or any other unlawful conduct or conduct expressly prohibited by this policy.

8. How to report allegedly illegal content

Any person or organisation may report content they consider illegal, even if they do not have a TimeDivers account.

The report must be sent by email to:

The recommended subject line is: Illegal content report

The report must include:

  1. The exact address of the affected timeline or content.
  2. Specific identification of the reported item, such as the event title, date, image, file, link or relevant extract.
  3. A sufficiently reasoned explanation of why the content is considered illegal.
  4. The law, right or interest allegedly infringed, where known.
  5. Any available documents, screenshots, decisions, licences, records or other evidence.
  6. The name of the person or entity submitting the report.
  7. A valid email address for receiving acknowledgement of receipt and the decision.
  8. A statement that the report is made in good faith and that the information provided is accurate and complete to the best of the reporter's knowledge and belief.

Where a report concerns possible child sexual abuse or exploitation material, the reporter will not be required to provide their name or any additional identifying details.

No specific legal wording or citation of a law is required to submit a report. However, the information provided must make it possible to locate the content and reasonably understand the possible infringement.

Where the report includes a valid email address, TimeDivers will acknowledge receipt without undue delay and subsequently communicate the decision taken.

9. Incomplete reports

If the report does not make it possible to identify the content or understand the possible infringement, TimeDivers may request additional information.

TimeDivers may take no action where:

  • The content cannot be located.
  • The address provided is incorrect or insufficient.
  • The report does not explain why the content is considered illegal.
  • The complaint is generic and does not identify specific elements.
  • The additional information requested is not provided.
  • The content is no longer available.

A lack of information will not prevent action where the illegality is manifest or there is a serious or urgent risk.

10. Review of reports

TimeDivers will examine reports diligently, objectively and proportionately.

During the review, it may:

  • Examine the reported content and related elements.
  • Request additional information from the reporter.
  • Request explanations or documentation from the responsible user.
  • Verify licences, authorisations or sources.
  • Consult publicly available information.
  • Temporarily restrict the visibility of content where there is an urgent risk.
  • Retain information necessary to investigate the facts or document the action taken.
  • Seek specialist advice.
  • Comply with instructions from administrative or judicial authorities.

Submitting a report does not automatically result in removal of the content.

TimeDivers will take into account:

  • The nature and seriousness of the possible infringement.
  • The clarity and credibility of the report.
  • The available evidence.
  • The context of the content.
  • The rights and interests of the persons concerned.
  • Whether the content is public, unlisted or private.
  • The risk of further harm.
  • Any repeated infringement.
  • The proportionality of the possible measures.

11. Measures TimeDivers may take

After reviewing the available information, TimeDivers may:

  • Take no action.
  • Ask for content to be corrected or removed voluntarily.
  • Restrict the visibility of a timeline.
  • Temporarily or permanently prevent public access to it.
  • Disable links, embeds or sharing mechanisms.
  • Remove an image, document, file, linked video, event, period or any other specific element.
  • Remove an entire timeline.
  • Restrict certain account features.
  • Temporarily suspend the account.
  • Close the account and terminate the contract.
  • Retain data necessary to deal with claims or comply with legal obligations.
  • Report the matter to the competent authorities where legally required.

Measures will be selected according to the seriousness, repetition and scope of the infringement.

Where removing a specific element is sufficient, TimeDivers will seek to avoid unnecessarily affecting the remaining lawful content.

In serious, urgent or legally required situations, TimeDivers may act without prior notice.

13. Content involving serious risks

Where content may pose an immediate risk to life, physical integrity or personal safety, or involve the commission of a serious criminal offence, TimeDivers may:

  • Immediately restrict or remove the content.
  • Suspend the account as a precautionary measure.
  • Retain the available information.
  • Report the matter to the competent authorities.
  • Comply with instructions received from those authorities.

TimeDivers will not give the user prior notice where doing so could increase the risk, frustrate an investigation, result in destruction of evidence or breach a legal obligation.

14. Communication of the decision

TimeDivers will communicate the decision taken without undue delay to the person who submitted the report, provided that they supplied a valid email address.

Where a measure is taken against content or an account, the affected user will also be informed unless this is prevented by law, an order from an authority or a legitimate security reason.

The communication may include:

  • The affected content or account.
  • The measure taken.
  • The main facts and circumstances considered.
  • The legal rule or contractual provision applied.
  • The duration of the measure, where temporary.
  • Whether automated tools were used to take the decision.
  • The possibility of requesting a review.

TimeDivers may limit the information provided where necessary to protect third parties, avoid risks, preserve confidentiality or comply with a legal obligation.

The reporter's identity will not be disclosed to the affected user unless this is necessary to process the complaint, defend rights or comply with a legal requirement.

15. Request for review

The person who submitted the report and the affected user may request a review of the decision within six months following its communication.

The request must be sent to: info@timedivers.net

The recommended subject line is: Request for review of a content decision

The request must identify:

  • The decision for which review is requested.
  • The affected timeline, content or account.
  • The reasons for disagreement.
  • Any additional evidence or explanations considered relevant.

A request for review will not automatically suspend the measure taken or provisionally restore the content.

The review will be carried out by a person and will not be decided exclusively by automated systems.

Where reasonably possible, the review will be carried out by a person other than the person who took the initial decision.

TimeDivers may:

  • Confirm the decision.
  • Modify the measure.
  • Reduce or extend its duration.
  • Restore the content in whole or in part.
  • Revoke the decision.

The outcome will be communicated with reasons.

The internal review does not limit the right of the persons concerned to apply to authorities, courts or other legally available mechanisms.

16. Export of removed content

Where technically and legally possible, TimeDivers may allow the user to export lawful content before its final deletion.

Export will not be provided where:

  • It is prohibited by law.
  • There is an order from an authority.
  • The copy would include illegal material whose return or possession is not permitted.
  • The export could place other persons or the service at risk.
  • It is not technically possible to separate lawful content from illegal content.

Removed timelines supplied through a ZIP export will not necessarily retain their visual customisation.

Even if the user later reimports the exported content and files, the appearance, visual settings or certain timeline configurations may not match the originals.

TimeDivers backups are not an individual archiving service and do not guarantee recovery of removed or deleted content.

17. Restoration of content

Where a review concludes that a measure was not justified, TimeDivers will seek to restore the affected content or access without undue delay.

Restoration may not be possible where:

  • The content has been permanently deleted.
  • The backup retention cycle has ended.
  • The files depend on external services that are no longer available.
  • There is a new legal or contractual ground preventing restoration.

Restoring a timeline does not guarantee exact recovery of its previous visual customisation.

18. Serious or repeated infringements

TimeDivers may suspend or close an account where there are:

  • Particularly serious infringements.
  • Repeated breaches.
  • Repeated publication of removed content.
  • Attempts to circumvent moderation measures.
  • Use of other accounts to continue prohibited conduct.
  • Fraud, impersonation or manipulation of the system.
  • Risks to the security of the platform or third parties.

Where appropriate, account will be taken of the number of infringements, their seriousness and frequency, the harm caused and the user's conduct after receiving notices.

19. Abuse of the reporting channel

The illegal content reporting channel must be used in good faith.

The following are not permitted:

  • Deliberately submitting false information.
  • Altering or fabricating evidence.
  • Impersonating another person.
  • Using the procedure to harass or unlawfully harm a user.
  • Repeatedly submitting manifestly unfounded reports.
  • Automating the mass submission of reports.

Where abuse is detected, TimeDivers may request clarification, give lower priority to repetitive reports or temporarily stop processing manifestly unfounded reports, after warning the person concerned where possible.

This measure will not prevent the processing of later reports that are sufficiently substantiated.

20. Personal data included in reports

Personal data provided when reporting content will be used to:

  • Receive and process the report.
  • Contact the reporter.
  • Investigate the facts.
  • Communicate the decision.
  • Defend rights.
  • Comply with legal obligations.
  • Cooperate with authorities where appropriate.

The information will be retained for as long as necessary to manage the report and any resulting liabilities.

21. Changes to this policy

TimeDivers may amend this policy to reflect:

  • Legal changes.
  • New features.
  • Technical or organisational changes.
  • New risks.
  • Changes to the moderation procedure.
  • Recommendations or requirements from authorities.

The current version will be the version published on timedivers.net and will be identified by its last updated date.

Material changes will be communicated by appropriate means where they significantly affect users' rights or obligations.
